hi Keith thanks for that its us law tends to be more on the buyers side
but on the plus side slowly slowly is working just waiting for a response from the factory
and then will deal with it
I have told them if we can not fined the cutting out problem 100% then (do not fit the new engine) as I will be retuning the bike unit for purpose    8)

don't blame you I would do the same ,it would be to late after if it cut out and you had a bad accident, there is a video on you tube of another k 1600 cutting out for no reason , on a motorway , if bmw can offer a full refund to one they should be able to do the same for other genuine cases   good luck

bike is going back to dealer who are refunding me
who I have to say been good and understand why I do not want the bike back
as for the damage done to the bike when it cut out bmw have replaced all the parts (foc)
this is why this bike has to have bmw warrantee
and why I have decided to stay with bmw
I pick up new bike in January
to all have a good new year and stay up and enjoy life to short  ;););) ;)hear comes summer
